Health Care Fraud Investigations & Prosecutions

Federal charges of Healthcare Fraud, Conspiracy to commit Healthcare Fraud, and violations of the federal Anti-Kickback Statute (AKS) are very commonly brought in southeastern Michigan and throughout the country.  The government, through its multi-agency Healthcare Fraud Strike Force, brings together federal prosecutors with agents from the HHS (Health and Human Services), FBI and DEA to aggressively investigate and charge anyone who has even a hint of involvement with alleged fraud.

The federal Health Care Fraud Strike Force that works in the Detroit and Flint areas is truly aggressive in how they operate. They will expend vast federal monies and resources to investigate and charge anyone who worked with doctors, nurses, pharmacists, home health care companies, visiting physician practices, pharmacists, and others whom they suspect committed any level of health care fraud.  The types of fraud they investigate include improper billing of Medicare (overbilling and billing for services that are medically unnecessary or not provided), improper certification of homebound patients, and the payment of kickbacks in connection with services billed to Medicare.

Know this:  If the entity that you either own or worked for is under investigation by the Health Care Fraud Strike Force, you should assume that you are also under investigation.  If that is the case, please read the section on this website entitled, “What Should You Do if You are Under Federal Investigation?”

There are a number of specific defenses that apply in the context of alleged health care fraud and AKS violations, so speaking with an attorney who is experienced in defending healthcare fraud Indictments is essential.  Those defenses include, among others, utilizing the “Safe Harbor” provisions found in the Code of Federal Regulations.
